ACCEPTANCE OF TERMS
1. Your access to and use of Jo Laing Ltd ("the Website") is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.
ADVICE
2. The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making, any decision.
CHANGES TO WEBSITE
3. Jo Laing Ltd reserves the right to:
3.1 change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that We shall not be liable to you for any such change or removal; and
3.2 change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.
LINKS TO THIRD PARTY WEBSITES
4. The Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.
COPYRIGHT & INTELLECTUAL PROPERTY
5. All intellectual property rights in and to the Website, including but not limited to the Website design, layout, text, images, graphics, logos, trademarks, product designs, artwork, photographs, illustrations, software, source code and other content, are owned by or licensed to Jo Laing Ltd and are protected by applicable intellectual property laws.
You may access and use the Website for your personal and non-commercial purposes only. You must not copy, reproduce, modify, distribute, publish, display, transmit, sell, license, or otherwise exploit any content from the Website without our prior written permission.
Any designs, artwork, templates, product concepts, personalisation layouts or creative elements produced by Jo Laing Ltd remain the intellectual property of Jo Laing Ltd unless otherwise agreed in writing.
Where we create a personalised product for you, you are granted permission to use the finished product for your own personal use. This does not transfer ownership of any intellectual property rights in the design, artwork, layout or creative elements used to produce that product.
You must not reproduce, copy, scan, photograph for commercial purposes, resell, manufacture, or create derivative products based on any designs or artwork created by Jo Laing Ltd without our prior written consent.
Where customers provide their own text, images, logos or other materials for personalisation, they confirm that they have the necessary rights, permissions and authority to use those materials. Customers agree that their use of such materials will not infringe the intellectual property rights, privacy rights or other rights of any third party.
Jo Laing Ltd reserves the right to refuse any order where the requested personalisation or supplied materials appear to infringe the rights of another person or organisation.
DISCLAIMERS AND LIMITATION OF LIABILITY
6.1 The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
6.2 To the extent permitted by law, Jo Laing will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.
6.3 Jo Laing makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
INDEMNITY
7. You agree to indemnify and hold Jo Laing and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Jo Laing Ltd arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.
SEVERANCE
8. If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
PAYMENT
9. Orders cannot be printed, packed or shipped if payment has not cleared.
All prices displayed on our Website are shown in the applicable currency and include VAT where required by law, unless otherwise stated. Delivery charges and any additional costs will be clearly displayed before you complete your order.
We take reasonable care to ensure that all prices, descriptions and product information displayed on our Website are accurate. However, errors may occasionally occur. If we discover an error in the price of an item you have ordered, we will contact you as soon as possible and give you the option to confirm your order at the correct price or cancel your order for a full refund.
Payment must be received and cleared before we begin production or dispatch your order. By placing an order, you confirm that you are authorised to use the payment method provided.
We accept payment methods displayed on our Website at the time of purchase. Payments are processed securely through third-party payment providers, and we do not store complete payment card details.
We reserve the right to refuse or cancel an order where:
- payment has not been received;
- we suspect fraudulent activity;
- the requested personalisation is unlawful, inappropriate or infringes the rights of another person or organisation;
- there is an error in the product description, pricing or availability.
If we cancel an order after payment has been received, we will provide a full refund of any amount paid unless the cancellation is due to a breach of these Terms by the customer.
For international orders, customers are responsible for any customs duties, import taxes, handling fees or other charges imposed by the destination country unless otherwise stated.
PERSONALISED ORDERS
10. When you order any personalised item through jolaing.com website, you acknowledge that you are responsible in full for the information you supply. The information you input is captured by the website in the exact format and spelling entered. We will correct and replace orders containing any errors caused by the studio. However should it be found that typos or mistakes were made on the order, the order will still be paid for in full. No refunds will be made. Should a customer wish to correct the errors, a new order will need to be placed.
Personalised orders cannot be refunded or exchanged.
By placing an order through our site, you warrant that:
(a) you are legally capable of entering into binding contracts;
(b) you are a ‘consumer’ (being an individual purchasing the Products outside the course of his or her business or trade); and
(c) you are at least 18 years old.
(d) Customers are responsible for ensuring that all information provided when placing an order is accurate, including names, dates, personalisation details, delivery addresses, email addresses and telephone numbers.
We cannot accept responsibility for delays, additional costs or replacement orders required as a result of incorrect information supplied by the customer.
If an error is identified before production or dispatch, please contact us immediately. Whilst we will always try to accommodate changes where possible, we cannot guarantee that amendments can be made once an order has entered production.
DELIVERY
11. Dispatch
11.1 We aim to dispatch all orders within the timescales stated on our website. Any delivery dates provided are estimates only and are not guaranteed.
Orders are delivered using independent third-party courier services. Once an order has been dispatched, delivery times are dependent upon the courier and are outside our reasonable control.
Delivery Address
11.2 Customers are responsible for ensuring that the delivery address provided at the time of ordering is complete and accurate.
Where an order is addressed to a business, workplace, private club, hotel, reception, or any other third-party premises, the customer accepts that delivery may be made to a person authorised or reasonably expected to accept deliveries at that location. Customers should ensure appropriate arrangements are in place for receipt of their order.
We are not responsible for delays, failed deliveries or additional costs resulting from an incorrect or incomplete delivery address provided by the customer.
11.3. International Deliveries
For international orders, customers are responsible for any import duties, customs charges, taxes or other local fees that may be payable in the destination country unless otherwise stated.
International delivery times are estimates only and may be affected by customs clearance or local delivery services.
11.4 Missing Deliveries
If you believe your order has not been delivered, you must notify us as soon as reasonably possible, within 30 days of the expected delivery date.
Prompt notification enables us to investigate the matter with the courier while tracking information and delivery records remain available. Courier records are retained for a limited period only, and delays in reporting may prevent us from carrying out a full investigation or obtaining proof of delivery.
If a missing delivery is reported, customers agree to cooperate with any reasonable investigation, including checking with members of the household, neighbours, reception staff, mailrooms, or any person or organisation that may have accepted delivery on their behalf.
11.5 Delivery Records
We retain records confirming dispatch of orders. Where available, courier tracking information, proof of collection and proof of delivery may be relied upon when investigating delivery enquiries. Please note after 120 days, most couriers do not hold records for proof of delivery. It is the customers responsibility to track their parcels and notify us of any concerns or problems.
Nothing in these Terms affects your statutory rights under applicable consumer protection law.
11.6 Force Majeure
We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control. These events may include, but are not limited to, severe weather, natural disasters, fire, flood, industrial disputes, shortages of materials, interruption to transport or courier services, customs delays, government action, pandemics, power failures or failures of telecommunications systems.
Where such circumstances arise, we will use reasonable endeavours to minimise disruption and fulfil affected orders as soon as reasonably practicable.
RETURNS, FAULTY GOODS AND CONSUMER RIGHTS
12. Due to the bespoke nature of some of our personalised products, personalised items cannot normally be cancelled, returned or exchanged where the item has been produced correctly in accordance with the information provided by the customer.
This does not affect your statutory rights. If your order arrives faulty, damaged, defective or materially different from what was ordered, please contact us as soon as possible with details of the issue and supporting photographs where appropriate.
We will assess the issue and, where appropriate, provide a repair, replacement, refund or other suitable remedy in accordance with applicable consumer protection laws.
Goods must be returned to us within 30 days of receiving them and we must be notified in writing, prior to you sending them back Jo Laing Ltd.
GOVERNING LAW
13. These Terms and Conditions, and any contract between you and Jo Laing Ltd, shall be governed by and interpreted in accordance with the laws of [Scotland/England and Wales].
If you are a consumer, you will also benefit from any mandatory protections provided by the laws of the country in which you are resident.
Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the jurisdiction of the UK courts of [Scotland/England and Wales], except where applicable consumer protection laws provide otherwise.
